Important Information: Assured Shorthold Tenancies

The Assured Shorthold Tenancy Notices and Prescribed Requirements (England) Regulations 2015 came into force today (1st October 2015) outlining information that must be served in respect of all new or renewed tenancies. It is important that you are aware of any changes that may affect you in order to remain compliant.

In relation to the Housing Act 1988, from 1st October 2015, a new prescribed form of section 21 notice must be served in order to seek recovery of possession under section 21 in respect of  all new or renewed tenancies.

In addition, certain requirements are outlined that landlords must comply with in order for a valid section 21 notice to be served. The prescribed legal requirements under the revised regulations provide that the tenant must have (prior to receipt of the notice) been in receipt of: section (2) (a) (c) an Energy Performance Certificate; section (2) (b) (d) a Gas Safety Certificate and section (3) (2) the document entitled ‘How to rent: the checklist for renting in England’. The tenant must be provided with hard copies of the first two documents. The How to Rent guide can be provided by email where the tenant has notified the landlord of an email address for service.
